Self-Drive Car Rental Agreement

OM RIDES SERVICES PRIVATE LIMITED

This Self-Drive Car Rental Agreement is a mandatory agreement between OM RIDES SERVICES PRIVATE LIMITED ("Company", "we", "us") and the customer ("Renter", "you"). By booking a vehicle, you acknowledge that you have read, understood, and agree to be bound by all terms and conditions outlined below.

1. Eligibility & Who Can Drive

  • The renter must be at least 21 years of age.
  • A valid Indian driving license (original) is mandatory and must be carried at all times during the rental period.
  • The license must be valid for the type of vehicle rented.
  • A government-issued ID proof (Aadhaar Card) is required for verification.
  • Only the registered renter whose documents are verified may drive the vehicle.
  • Allowing any unauthorized person to drive the vehicle is strictly prohibited and voids all protections.

2. Vehicle Usage Rules

  • All rentals are self-drive only. No driver or chauffeur service is provided.
  • The vehicle must not be used for any commercial purposes including taxi services, ride-sharing, or goods transport.
  • Sub-letting or re-renting the vehicle to any third party is strictly prohibited.
  • The vehicle must not be used for racing, rallying, or any competitive motorsport activities.
  • The vehicle must not be driven on unpaved roads, off-road terrains, or areas prone to flooding.
  • Smoking inside the vehicle is strictly prohibited. A cleaning fee of ₹2,000 will be charged for violations.
  • Pets are not allowed inside the vehicle without prior written approval.

3. Outstation Usage Policy

  • Outstation self-drive trips are permitted with prior intimation at the time of booking.
  • The renter must provide the intended route, destination, and expected return date.
  • Interstate travel may require additional documentation and charges.
  • The vehicle must not be taken to restricted areas, border regions, or areas with active travel advisories.
  • For trips exceeding 300 km/day, additional per-kilometer charges will apply as per the rate card.

4. Speed Limits, Traffic Rules & Prohibited Activities

  • The renter must adhere to all traffic laws, speed limits, and road regulations.
  • All traffic challans, fines, and penalties incurred during the rental period are the sole responsibility of the renter.
  • The vehicle is equipped with GPS tracking for security purposes. Tampering with the GPS system is prohibited and will result in legal action.
  • Zero tolerance policy for drunk driving, driving under the influence of drugs, or any illegal activities.
  • Over-speeding beyond safe limits may result in immediate termination of the rental agreement.

5. Fuel, FASTag & Cleanliness Policy

  • The vehicle will be provided with a certain fuel level (documented at pickup). The renter must return the vehicle with the same fuel level.
  • Any shortage in fuel at the time of return will be charged at ₹150/litre.
  • FASTag charges for toll usage during the rental period will be deducted from the security deposit or billed separately.
  • The vehicle must be returned in a reasonably clean condition. Excessive dirt, stains, or mess will incur a cleaning fee of ₹500-₹2,000 depending on the condition.

6. Security Deposit & Refund Timeline

  • A refundable security deposit of ₹5,000 - ₹15,000 (depending on vehicle type) is required before vehicle handover.
  • The deposit can be paid via UPI, bank transfer, or cash.
  • The security deposit will be refunded within 3-7 working days after vehicle return, subject to:
    • No damage to the vehicle
    • No pending challans or fines
    • Fuel level matching pickup level
    • Vehicle returned on time
    • No cleaning fee applicable
  • Any deductions will be communicated with proper documentation.

7. Damage, Accident & Insurance Responsibility

  • All vehicles are covered under basic third-party insurance as per Indian law.
  • The renter is responsible for any damage caused to the vehicle during the rental period, including:
    • Scratches, dents, and body damage
    • Windshield and glass damage
    • Interior damage
    • Mechanical damage due to misuse
    • Tire and wheel damage
  • In case of an accident:
    • Immediately inform OM Rides at +91 6393138654
    • File an FIR if required
    • Do not move the vehicle without company approval
    • Take photographs of the scene and damage
  • The renter bears full liability for any damage not covered by insurance or caused due to negligence, reckless driving, or policy violations.

8. Late Return, Extensions & Recovery Rights

  • The vehicle must be returned by the agreed date and time.
  • A grace period of 30 minutes is allowed. Beyond this:
    • 1-3 hours late: ₹300 penalty
    • 3-6 hours late: Half-day rental charge
    • 6+ hours late: Full day rental charge
  • Extensions must be requested at least 4 hours before the scheduled return time, subject to availability.
  • Failure to return the vehicle or communicate will be treated as theft and reported to authorities.
  • OM Rides reserves the right to recover the vehicle using GPS tracking if the renter fails to return it or becomes unreachable.

9. Personal Belongings Disclaimer

  • OM Rides is not responsible for any personal belongings left inside the vehicle.
  • Please check and remove all your belongings before returning the vehicle.
  • Found items will be held for 7 days. Unclaimed items will be disposed of.

10. Legal & Enforcement Rights

  • This agreement is governed by the laws of India and the jurisdiction of courts in Lucknow, Uttar Pradesh.
  • OM Rides reserves the right to terminate the rental agreement immediately and recover the vehicle if any terms are violated.
  • Legal action will be initiated for any criminal activity, fraud, or misuse of the vehicle.
  • The renter agrees to cooperate fully with authorities and OM Rides in case of any investigation.

Important Warning

Misuse, illegal activity, drunk driving, over-speeding, or allowing unauthorized drivers will void all protections under this agreement and make the customer fully liable for all damages, losses, legal fees, and penalties. OM Rides will report such incidents to law enforcement authorities.
